WithAI Privacy Policy

This Privacy Policy describes how WithAI Research, Inc. ("Company", "we", "us") collects, uses, and protects your information when you use the WithAI VS Code extension ("Service").

1. What We Collect and Why

Information You Provide

Email Address (Optional)

• Collected via the welcome popup when you first install the Service
• Used for: Product updates, announcements, and important notices
• You can skip this entirely

Company Name (Optional)

• Collected via the welcome popup
• Used for: Understanding our user base
• You can skip this entirely

Information We Do NOT Collect

• Your files and code: We do not read, access, store, or transmit your markdown files or any other files on your system
• Your keystrokes or editing activity: We do not monitor what you type
• Usage analytics: We do not track which features you use or how often
• Device identifiers: We do not collect hardware IDs or fingerprints

Settings and Preferences

Your extension settings (theme, editor preferences, etc.) are stored locally in VS Code's settings system on your machine. We do not have access to these.

2. How We Use Your Information

If you provide your email address, we use it to:

• Send occasional product updates and announcements
• Notify you of important changes to the Service or these policies
• Facilitate communication between members of our team to get product feedback

We will not:

• Sell your email to third parties
• Send spam or marketing from unrelated parties
• Share your information except as described in this policy

3. Third-Party Services

Google Forms

Email addresses submitted through the welcome popup are sent to Google Forms for collection. Google's privacy policy applies to this data: https://policies.google.com/privacy

Third-Party Extensions

The Service may recommend installing third-party VS Code extensions:

• Claude Code (Anthropic) - Subject to Anthropic's privacy policy
• Office Viewer (cweijan) - VS Code Marketplace terms apply
• Material Icon Theme (PKief) - VS Code Marketplace terms apply

We do not control these extensions and are not responsible for their data practices.

VS Code Marketplace

The Service is distributed via the VS Code Marketplace, operated by Microsoft. Microsoft's privacy policy applies to the marketplace: https://privacy.microsoft.com/

4. Data Storage and Security

• Email data: Stored in Google Forms/Sheets, secured by Google's infrastructure
• Local data: Your files and settings remain on your machine and are never transmitted to us

We do not operate servers that store your personal data (beyond the Google Forms integration).

5. Your Rights

You have the right to:

• Access: Know what data we have about you
• Correction: Request correction of inaccurate data
• Deletion: Request deletion of your data
• Portability: Receive your data in a portable format

You have rights under GDPR including access, rectification, erasure, and data portability. Our lawful basis for processing is consent (you choose to provide your email) and legitimate interest (providing the Service).

6. Children's Privacy

The Service is not directed at children under 13. We do not knowingly collect information from children under 13. If you believe a child has provided us with personal information, please contact us at ben@withai.nyc.

We may update this Privacy Policy from time to time. We will notify users of material changes by updating the "Last updated" date at the top of this page. Continued use of the Service after changes constitutes acceptance of the updated policy.
