Thank you for using WithAI! These Terms of Service ("Terms") govern your use of the WithAI VS Code extension ("Service") provided by WithAI Research, Inc. ("Company", "we", "us").

By installing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Account Terms

• You are responsible for maintaining the security of your VS Code environment and any accounts connected to it.
• You are responsible for all activity that occurs under your use of the Service.
• You must be a human. Automated bots or scripts are not permitted to use the Service.
• You must provide accurate information when prompted (e.g., email address in the welcome form).

2. Use of the Service

The Service is a VS Code extension that provides:

• A WYSIWYG markdown editor
• Claude Code settings management
• Workspace setup and configuration tools

You may not use the Service to:

• Violate any laws or regulations
• Infringe on intellectual property rights
• Transmit malware or malicious code
• Attempt to gain unauthorized access to any systems
• Harass, abuse, or harm others
• Interfere with or disrupt the Service

We reserve the right to disable or remove the Service from any user who violates these terms.

3. Third-Party Extensions

The Service may recommend or install third-party VS Code extensions:

• Claude Code (by Anthropic)
• Office Viewer (by cweijan)
• Material Icon Theme (by PKief)

These extensions are governed by their own terms and privacy policies. We are not responsible for third-party extensions. Your use of third-party services (including Claude/Anthropic) is subject to their respective terms.

4. Intellectual Property

The Service and all associated intellectual property are owned by WithAI Research, Inc. All rights reserved.

You may not:

• Copy, modify, or distribute the Service
• Reverse engineer or decompile the Service
• Remove any proprietary notices from the Service
• Use our trademarks without permission

5. Data and Privacy

Our collection and use of personal information is described in our Privacy Policy.

In summary:

• We collect only your email and company name (if provided) via the welcome form
• We do not access, store, or transmit your files or code
• Your markdown files remain entirely local to your machine
• We do not sell your data

6. Service Availability

We provide the Service "as is" and make no guarantees about:

• Uninterrupted availability
• Error-free operation
• Compatibility with all systems or configurations

We may modify, suspend, or discontinue the Service at any time without notice.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WITHAI RESEARCH, INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

• Your use or inability to use the Service
• Any unauthorized access to your data
• Any third-party conduct on the Service
• Any other matter relating to the Service

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE PAST TWELVE MONTHS (WHICH IS $0 FOR THIS FREE SERVICE).

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9. Changes to Terms

We may update these Terms from time to time. We will notify users of material changes by updating the "Last updated" date. Continued use of the Service after changes constitutes acceptance of the new Terms.

10. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.
